Terms of Service

1. Acceptance of Terms

By accessing or using the Pool Companion platform at poolcompanion.com.au (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use the Service. These Terms constitute a legally binding agreement between you and Pool Companion Pty Ltd (“Pool Companion”, “we”, “us”, or “our”).

2. Description of Service

Pool Companion is a software-as-a-service (SaaS) platform designed for pool service businesses operating in Australia. The Service provides:

• Route optimization for service technicians across multiple modes (time, distance, priority, and area clustering)
• Job scheduling and recurring job management
• Dispatch management with interactive map views
• Client and pool management
• Technician assignment and team management
• Invoicing and billing tools
• Schedule analysis and reporting

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice to active subscribers.

3. Account Registration

To use the Service, you must create an account. By registering, you represent and warrant that:

• You are at least 18 years of age.
• All information you provide during registration is accurate, current, and complete.
• You will maintain and promptly update your account information to keep it accurate.
• You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account.
• You will immediately notify us of any unauthorised use of your account.

We reserve the right to suspend or terminate accounts that contain inaccurate or misleading information.

4. Subscription & Billing

Pool Companion offers a 14-day free trial for new accounts. No credit card is required to start your trial. After the trial period:

• You must select a paid subscription plan to continue using the Service.
• All billing is processed securely through Stripe. We do not store your payment card details on our servers.
• Subscriptions are billed on a recurring monthly or annual basis, depending on the plan selected.
• Subscriptions auto-renew at the end of each billing period unless cancelled before the renewal date.
• You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period.
• Refunds are not provided for partial billing periods, except where required by Australian Consumer Law.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations, including Australian privacy and consumer protection laws.
• Abuse, harass, or harm other users or any third party.
• Scrape, crawl, or use automated tools to extract data from the Service without our express written consent.
• Attempt to gain unauthorised access to the Service, other accounts, or related systems or networks.
• Upload or transmit viruses, malware, or other harmful code.
• Interfere with or disrupt the integrity or performance of the Service.
• Use the Service for any purpose other than managing a legitimate pool service business.

Violation of these terms may result in immediate suspension or termination of your account.

6. Intellectual Property

The Service, including all software, design, text, graphics, logos, and other content, is owned by Pool Companion and is protected by Australian and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service for the duration of your subscription.

Your data remains yours. You retain all ownership rights to the business data you enter into the Service, including client information, job records, and invoices. We do not claim any intellectual property rights over your data.

7. Data & Privacy

Your privacy is important to us. Our collection, use, and handling of personal information is governed by our Privacy Policy, which forms part of these Terms. By using the Service, you consent to the practices described in our Privacy Policy.

8. Limitation of Liability

To the maximum extent permitted by law, the Service is provided on an “as-is” and “as-available” basis. Pool Companion makes no warranties, express or implied, regarding the Service, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Pool Companion shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the Service.

Our total liability to you for any claim arising from or related to these Terms or the Service shall not exceed the total amount you paid to us in the twelve (12) months preceding the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian Consumer Law.

9. Termination

Either party may terminate this agreement at any time:

• You may cancel your subscription at any time through your account settings. Your access will continue until the end of the current billing period.
• We may terminate or suspend your account immediately if you breach these Terms, or with 30 days' notice for any other reason.

Upon termination, you will have 30 days to export your data from the Service. After this period, your data will be permanently deleted in accordance with our data retention policy.

10. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and cancel your subscription.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New South Wales, Australia. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
